Terms of Service

Track & Table (“we”, “us”) is an NYC diet companion for people who eat out. By using the app you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the service.

The product is built for adults in the United States, with a focus on New York City restaurants and gyms. You must be at least 18 and able to enter a binding agreement. We may refuse, suspend, or close accounts that break these terms or misuse the service.

We provide an AI companion, restaurant recommendations, food and workout logging, a flexible weekly calorie budget, and related features. Features can change, break, or go away as we ship. We don’t promise uninterrupted uptime or that every restaurant, menu item, or calorie estimate is perfect — ranges and estimates are honest best-effort, not lab measurements.

Not medical advice. Track & Table is a lifestyle and coaching product, not a doctor, dietitian, or medical device. Don’t use it to diagnose, treat, or manage a health condition. Talk to a qualified professional before making big changes to diet, exercise, or weight goals.

You’re responsible for your login credentials and for activity under your account. Keep your info reasonably accurate. You can delete your account in the app (Account → delete); that permanently removes associated data we control, subject to short operational backups and legal retention if any ever applies.

You own the content you submit (chat messages, food photos, logs, preferences, and so on). You grant us a license to use that content only as needed to run, improve, and secure the product — including sending it to third-party model and infrastructure providers that power the companion. Don’t upload anything you don’t have rights to, and don’t put illegal or harmful material in the app.

Don’t:

• Break the law or encourage others to
• Harass people, spam, or abuse the product or our staff
• Probe, scrape, reverse-engineer, or overload our systems
• Impersonate others or create accounts for anyone but yourself
• Resell or redistribute the service without permission
• Use the AI to generate scams, malware, or other clearly abusive content

We may throttle, suspend, or ban accounts that cross those lines.

The companion can be wrong, incomplete, or weird. Double-check recommendations that matter (allergies, medical constraints, prices). You’re responsible for what you actually order and eat.

If we charge for parts of the product later, pricing and billing terms will be shown before you buy. Until then, free access may still have usage limits or invite-only gates.

The service is provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that estimates, recommendations, or availability will meet your expectations.

To the fullest extent allowed by New York law, we and our operators won’t be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for any claim related to the service is limited to the greater of (a) what you paid us in the 12 months before the claim, or (b) $50.

You agree to defend and hold us harmless from claims arising out of your misuse of the service, your content, or your violation of these terms.

We may update these terms. We’ll bump the “Last updated” date above; continued use after a change means you accept the new terms. Material changes may also get an in-app note when it makes sense.

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Courts in New York County, New York have exclusive venue for disputes, except where applicable law says otherwise.
